These Terms and Conditions ("Terms") constitute a binding agreement between you ("you" or "Client") and Vibha Tyagi, located in Fort Worth, Texas, USA ("Vibha Tyagi," "we," or "us"). By purchasing any product, accessing any service, or using any digital property associated with vibhatyagi.com, you agree to these Terms in full.

If you are purchasing on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Our products are designed to surface information gaps and patterns within organizations, and to provide frameworks for strategic conversation and decision-making. Results and recommendations are intended as inputs to your own judgment — not as the sole or determinative basis for any consequential decision.

Specifically, our products and services are not:

• A substitute for qualified legal, financial, medical, HR, or organizational consulting advice
• Certified psychometric instruments validated for employment screening, hiring, or termination decisions
• A guarantee of any particular business outcome, performance improvement, or return on investment
• Professional therapy, counseling, or mental health services

We strongly recommend that any major organizational decision — including but not limited to restructuring, workforce changes, or strategic pivots — be reviewed with appropriately qualified advisors before implementation.

No part of any material may be reproduced, redistributed, resold, sublicensed, or used to train artificial intelligence models without prior written permission.

Permitted use: Upon purchase, you receive a personal, non-transferable license to use the specific product or service purchased for your own internal organizational purposes. This license does not include the right to reproduce the frameworks, resell access, or deliver services to third parties using our proprietary methodologies.

The Awareness Equity Assessment — including individual, team, and organizational variants — is a self-report diagnostic instrument. Results reflect the responses provided by participants and are subject to the accuracy and candor of those responses.

Delivery timelines: Individual AI Action Briefs are delivered within 48 hours of assessment completion. Team and composite reports are delivered within 72 hours of all team members completing their assessments. Timelines may extend by up to 5 business days during high-volume periods; we will notify you proactively if this occurs.

Use of results: Assessment results are provided for your internal strategic use only. You may share your own results with colleagues and advisors. You may not publish, reproduce, or redistribute assessment reports — in full or in part — without written consent.

Limitations of the instrument:

• Results are not validated for use in employment decisions including hiring, promotion, or termination
• Results reflect a point-in-time snapshot and may not capture recent organizational changes
• Scores represent diagnostic indicators, not absolute organizational ratings
• The AE Failure Signature is a named pattern, not a clinical classification

Team assessments require all designated participants to complete the assessment for a composite report to be generated. If one or more participants do not complete within 30 days of purchase, a partial report will be delivered based on available responses. No refunds are issued for non-participation by team members.

The Awareness Equity Community membership is billed monthly at the rate displayed at the time of purchase. Membership may be cancelled at any time; cancellation takes effect at the end of the current billing period. No partial-month refunds are issued.

Community membership includes access to monthly live sessions, the frameworks portal, peer cohort discussions, and a complimentary physical copy of Awareness Equity (shipped within 5 business days of joining). The physical book is a one-time benefit and is not re-issued upon rejoining after cancellation.

Community participants agree to:

• Maintain the confidentiality of peer discussions — what is shared in the community stays in the community
• Engage respectfully and professionally with other members
• Not record, reproduce, or redistribute session content without written permission
• Not use community access to solicit other members for competing products or services

We reserve the right to remove any member who violates community standards, without refund of current-period fees.

All payments are processed securely through Stripe. We do not store credit card information. Prices are listed in USD and are subject to change; the price displayed at the time of purchase is the price you pay.

Assessment products (individual, team, and organizational): All sales are final. Because assessment delivery begins immediately upon purchase, refunds are not available once the assessment link has been issued or the assessment has been completed.

Exception: If a technical error prevents you from completing or receiving your assessment, contact us within 7 days at vibha@vibhatyagi.com and we will resolve the issue at no additional charge.

Community membership: Monthly membership fees are non-refundable. You may cancel at any time to prevent future charges.

Coaching and consulting engagements: Payment terms for bespoke engagements are specified in individual agreements. Unless otherwise stated in writing, deposits are non-refundable and final payments are due upon delivery.

All products and services are provided "as is" and "as available." We make no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We are not liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Business decisions made in reliance on assessment results or framework recommendations
• Lost profits, lost revenue, or lost business opportunities of any kind
• Outcomes of organizational changes, workforce decisions, or strategic pivots informed by our products
• Delays in delivery caused by participant non-completion, force majeure, or circumstances outside our reasonable control

Some jurisdictions do not permit the exclusion of certain warranties or limitations of liability. In such cases, our liability is limited to the maximum extent permitted by law.

We collect only the information necessary to deliver our products and services. This includes your name, email address, organization, role, and assessment responses.

How we use your data:

• To deliver your assessment report, community access, or requested service
• To communicate with you about your purchase and related updates
• To improve our assessment instrument and frameworks (using anonymized, aggregated data only)
• To send occasional relevant communications — you may unsubscribe at any time

What we do not do: We do not sell, rent, or share your personal data or assessment responses with third parties for marketing purposes. Individual assessment results are never disclosed to employers, third parties, or other community members without your explicit written consent.

Third-party platforms: Email communications and subscriber management are handled through Kit (kit.com). When you submit your email address through any form on this site, that data is stored in Kit and subject to Kit's privacy policy in addition to these Terms. Kit may use subscriber data for their own marketing purposes on their free plan. You may request removal of your data from Kit at any time by contacting us. This site is hosted on Netlify (netlify.com) and automation workflows run through Zapier (zapier.com) — neither platform sells your personal data to third parties.

For team assessments, the purchasing coordinator receives the composite team report. Individual responses contributing to that report are anonymized at the respondent level in the composite view, consistent with the terms disclosed at the time of purchase.

You may request deletion of your personal data at any time by contacting vibha@vibhatyagi.com. We will process your request within 30 days.

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall first be submitted to good-faith mediation before either party may pursue litigation.

You agree that any legal proceedings shall be conducted in the courts of Tarrant County, Texas, and you consent to the personal jurisdiction of such courts.

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will notify active community members by email at least 14 days before the changes take effect. Your continued use of our products or services after that date constitutes acceptance of the revised Terms.
